Terms and Conditions (“T&C’s”)

1. Introduction

1.1 The following Terms and Conditions (“T&Cs“) apply to your use of this Beyond Surviving website (the “Website“) available at www.beyondsurviving.ie and any Services and resources, including Services offered by Beyond Surviving and any Services and resources offered by any third-party services or event providers (“Linked Sites1”) which have been made available on the Website (“Services“). For the purpose of this document, “use“ includes visiting the Website, browsing and engaging with any Content which has been made available on the Website or through our newsletter distributions, social media platforms, email distributions, volunteer, recruitment & engagement processes, or any other communication channels we use, uploading Content and other user-generated content (UGC) and registering to use and engaging with any Services. For the avoidance of doubt, “Content” refers to the information, material, submissions, comments, content and functionalities which are made available on the Website for “use”.

1.2 The Website is operated by Beyond Surviving Charity Limited by Guarantee (alternatively “Beyond Surviving“ / “Beyond Surviving™” / “Beyond Surviving CLG“ / “we“ / “our“ / “us“) and these Terms and Conditions are issued by Beyond Surviving CLG (Registered Charity Number 20206738) of Castlebar, Co. Mayo, Republic of Ireland. These T&Cs set out the rights and obligations of all users (“you“ / “your“ / “user“) in relation to your use of our Website. 

1.3 By using the Website, you agree to the following T&Cs and accept these terms as binding upon you (“the Agreement”), including additional T&Cs and policies referenced herein or available by hyperlink and that you agree to comply with them. If you do not agree to these Terms, you must not use our Website.

1.4 Please refer to Section 18 of this document before proceeding with reading the contents of this ‘Terms and Conditions’ as Section 18 explains the abbreviated terms mentioned throughout this document and on our Website.

2. Information on this Website

2.1 Our Website aims to provide users with updates on our work with Beyond Surviving. The contents of this Website such as text, graphics, images, logos, branding, software and other material content are protected by copyright under both Irish and foreign laws. The Beyond Surviving intellectual property includes, but is not limited to, graphics, design, branding, computer code and interactive features. You may not sell, modify or distribute the content to reproduce, display, communicate, make available, publicly perform, distribute, or otherwise use the content in any way for any public or commercial purpose without expressly receiving the consent of Beyond Surviving.

2.2 If you violate any of these T&Cs or any written permissions granted by Beyond Surviving, your permission to use the content automatically terminates and you must immediately destroy any copies you have made of the content.

3. Acceptable Use

3.1 You accept sole responsibility for any information that you upload, share, exchange with or display on the Website, including for the accuracy of the information uploaded.

3.2 You must not use the Website for any illegal or unauthorised purpose. Users residing outside of Ireland agree to comply with all local laws regarding acceptable online conduct. You must not engage in any attempt to modify, adapt, copy, or hack the Website. This includes falsely implying that another service or third-party is affiliated with the Website. You must not crawl, scrape, or otherwise cache any content from the Website, including (but not limited to) personal details, photos, graphics, scripts or other content. You must not intentionally upload or transmit any viruses, malware, trojans, worms, spyware, adware, or any other malicious, destructive, or unauthorised software to the Website.

3.3 The Beyond Surviving Website contains Content that is designed to enable users to communicate with the public at large or with a group and you agree to use the Website in ways that are proper and related to our work and the purpose of our Website and community we endeavour to create. By way of example, and not as a limitation, you agree that when using and engaging with our Website, community and Services, you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Sell, copy, reproduce, distribute, modify or otherwise exploit intellectual property owned by Beyond Surviving.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • Use our Website if you are not at least 18 years of age.
  • Upload, share or create content regarding Child Sexual Abuse, of any nature, both current or historic. Although our Website is only for those users/ visitors 18 years old and older, if we do receive personal data and information or sensitive personal data and information that contains identifiable information about a minor that contains child protection or welfare concerns, we have a duty to report any such concerns to appropriate authorities (such as Tulsa), as per the ‘Children First National Guidance for the Protection and Welfare of Children 2017’ (National Guidance for the Protection and Welfare of Children) and/ or An Garda Síochana (the Irish police).
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
  • Upload files that contain viruses, corrupted files, or any other similar software or programmes that may damage the operation of another’s computer.
  • Use any part of the materials on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such messages are allowed. Our Website does allow users to recommend Services and goods that relate to our Website and are in the best interests of the community Beyond Surviving aims to foster. By way of example, but not by way of limitation, users can share the details of Services and goods they find useful along the healing journey and hold in positive regard (e.g. a book, a yoga instructor’s service details, etc.). This option for users is not to be confused with writing reviews or negatively commenting on us or any third-party Services or event providers. Beyond Surviving reserves the right to not publish details of Services and goods should we deem it necessary in the best interests of our Website users and community.
  • Conduct or forward surveys, contests, pyramid schemes or chain letters.
  • Download any file posted by another user of a service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Website.
  • Violate any code of conduct or other guidelines which may be applicable for any particular service.
  • Harvest or otherwise collect information and data about others, including email addresses and names, without their consent.
  • Violate any applicable laws or regulations.
  • Copy, reproduce, transmit, distribute or display, by any means, the materials on this Website, without the express written consent of Beyond Surviving.

Beyond Surviving has no obligation to monitor the communication channels. However, Beyond Surviving reserves the right to review Content received through users use of the Website and to remove any Content in its sole discretion. Beyond Surviving reserves the right to terminate your access to any or all of the Website at any time without notice for any reason whatsoever.

Beyond Surviving reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to publish or to remove any Content, in whole or in part, in Beyond Surviving’s sole discretion.

Always use caution when giving out any personally identifying information and data about yourself and your children in any communication channel. Beyond Surviving does not control or endorse the Content, messages or information found in any communication channel and, therefore, Beyond Surviving specifically disclaims any liability with regard to the communication channels and any actions resulting from your participation in any communication channel. The views of managers, hosts and administrators of Beyond Surviving and our Website do not necessarily reflect those of Beyond Surviving.

Materials and Content uploaded to a communication channel may be subject to published limitations on usage, reproduction and dissemination. You are responsible for adhering to such limitations if you download the materials and Content.

Such ‘communication channels’ include social media platforms.

4. Warranty

4.1 You warrant that any contribution to the Website complies with the acceptable use standards set out in Section 3 (‘Acceptable Use’) of these T&Cs, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

5. Links to third-party sites

The Beyond Surviving Website may contain links to other websites and Services with and by any third-party services, websites or providers (“Linked Sites”) which have been made available on our Website. The Linked Sites are not under the control of or owned by Beyond Surviving and we are not responsible for the contents, information and material of any Linked Sites, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Beyond Surviving is not responsible for webcasting or any other form of transmission received from any Linked Site. Beyond Surviving is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Beyond Surviving of the site or any association with its operators or operations. Once you leave our Website and access any Linked Site, you are subject to the terms and conditions, privacy policies, and practices of that website and Linked Site. We do not assume any responsibility for the content, policies, or practices of any third-party websites. It is your responsibility to review and comply with the applicable terms and conditions and privacy policies of the external websites you visit. By using our Website, you confirm that this is understood and you agree.

6. User-generated content

6.1 Beyond Surviving reserves the right to remove any user-generated (“UGC”) content which violates our ‘Community Guidelines’. We reserve the right to take similar action if we determine that the UGC infringes the rights and freedoms of others, or violates the terms set out in these T&Cs and our ‘Privacy Policy’. Such actions will be undertaken at our sole discretion, but we assume no obligation to do so in every circumstance.

6.2 We are the owner or the licensee of all intellectual property rights in the Website (except where specifically identified as third-party content), and in the material published on it. Beyond Surviving’s intellectual property includes, but is not limited to, graphics, design, branding, computer code and interactive features. The intellectual property of Beyond Surviving™ is a registered trademark and is filed under the Intellectual Property Office of Ireland (trademark registration number: 270505).

6.3 Except for the making of a hard copy print for your own personal use only or the use of others in your organisation (or downloading the material for your own personal use or the use of others in your organisation only provided that you retain all copyright and proprietary notices), the materials on this Website may not be copied, reproduced, transmitted, distributed or displayed, by any means, without the express written consent of the Beyond Surviving.

7. Privacy and Data Protection

Any personal data and information which you provide and is collected and processed by Beyond Surviving in connection with your use of the Website and Services will be processed securely and in accordance with our ‘Privacy Policy’.

By using our Website and agreeing to our T&Cs, the user confirms that they have read, understand and agree to our Privacy Policy and the information we have set out relating to the user anonymity and in some cases, lack thereof, and hereby enter into ‘the Agreement’.

To protect user privacy and confidentiality, some of Beyond Surviving’s Website uses functionalities where the user anonymity is maintained and protected2 and some parts of our Website where the user anonymity is not maintained or protected (however, Beyond Surviving cannot garauntee anonymity is maintained and protected in all cases).

For the avoidance of doubt, “anonymity is maintained and protected” means any identifiable information, such as your name, email address, or other personal and/ or sensitive data provided by you, will be redacted before publishing it online to our Website in accordance with our ‘Review Guidelines’ and ‘Privacy Policy‘. It does not mean, however, that administrators of Beyond Surviving and those with whom we share your personal data and/ or sensitive data (in accordance with our ‘Privacy Policy‘) cannot see, collect and process your personal data and/ or sensitive data, such as your name, email address, and other personal and/or sensitive data provided by you. You should be aware of this prior to using our Website and Services.

Users should be aware of when their anonymity is maintained and protected on our Website and when it is not, including instances where identifiable information about users or others may be revealed on our Website. We urge users to familiarise themselves with the below information about their anonymity before using and engaging with our Website, Content and Services and other platforms, such as our social media and networking platforms:

Submitting user-generated content using the ‘Share your Journey’ functionality: The user has the opportunity to share their healing journey with the Beyond Surviving community. This functionality can be found on the top right hand side of our Website by pressing the ‘SHARE YOUR JOURNEY’ button and submitting UGC. Further CTA (call-to-action) buttons can be found elsewhere on the Website which also direct the user to this functionality (such as ‘SHARE YOUR JOURNEY’ on the ‘YOUR HEALING’ page and through our other communication channels such as social media and newsletter distributions). UGC submitted through this functionality will always be published anonymously to our Website and in some cases, across our social media platforms and other networking platforms or methods of communication and any identifiable information redacted.The Survivor’s Hub: ‘THE SURVIVOR’S HUB’ page on our Website is designed in a way so that survivors and victims of DSGBVA and their supporters can search for upcoming events & more and register their interest in attending and participating in such event/ service offerings. Registration and participation is completely optional and at the sole discretion of each individual user. By registering your interest in or participating in any of the events and Services listed on this page of our Website, or promoted on any other communication channels we may use, you, the user, confirm your understanding that your anonymity is not maintained or protected by us and others, and identifiable information about yourself or another person may be revealed and shared on our Website (by way of example, your name or email address may be publically listed on an event registration page). The same applies when you register your interest in or participate in any of the events or Services which are listed on this page of our Website, or promoted on any other communication channels we may use, and are linked to a third-party event ticketing platform page (e.g. Eventbrite), a third-party service provider or a third-party Linked Site.
Commenting on other user-generated content: The user has the opportunity to comment on other UGC which has been published on the Website (as long as the user who submitted the UGC enabled commenting on their submission) and made available through the ‘YOUR HEALING’ page of the Website. UGC submitted through this functionality will always be published anonymously to our Website and in some cases, across our social media platforms and other networking platforms or methods of communication and any identifiable information redacted.Social media links: When you, the user, click on any of our social media links (e.g. Instagram, TikTok, Facebook, Threads), you confirm your understanding that you are leaving our Website and entering global social networking platforms. Please be aware that your anonymity is not maintained or protected by us when you engage with and use such social media platforms. It is every individual’s responsibility to maintain and protect their own anonymity (should they wish) when leaving our Website including leaving our Website through any social media links and Linked Sites made available by us.
Third-party links: When you, the user, click on any third-party links which have been made available on our Website, or on any other communication channels we may use, you confirm your understanding that you are leaving our Website and we, Beyond Surviving, can not guarantee that your anonymity is maintained or protected. It is every individual’s responsibility to maintain and protect their own anonymity (should they wish) when leaving our Website including leaving our Website through any third-party links and Linked Sites made available by us.
Donation link: When you, the user, click on the ‘DONATE’ buttons (located on our Website and through our other communication channels such as social media and newletter distributions), you confirm your understanding that you are leaving our Website and we, Beyond Surviving, can not guarantee that your anonymity is maintained or protected. It is every individual’s responsibility to maintain and protect their own anonymity (should they wish) when leaving our Website including leaving our Website through any donation links and Linked Sites we have made available. Should you wish to make a donation through iDonate, there is however, an option to donate anonymously should you wish. Please read the instructions carefully prior to donating and it is your responsibility to ensure you have maintained and protected your own anonymity.
Facebook & ‘The Survivor’s Group Chat’: When you, the user, click on the link ‘JOIN GROUP CHAT’ which can be found in the ‘RESOURCES’ section of our ‘THE SURVIVOR’S HUB’ page or through our other communication channels such as social media and newsletter distributions, you confirm your understanding and agreement that you are leaving our Website and entering a global social networking platform. Please be aware that your anonymity is not maintained or protected by us when you engage with and use such social media platforms such as Facebook. It is every individual’s responsibility to maintain and protect their own anonymity (should they wish) when leaving our Website including leaving our Website through any social media links and Linked Sites made available by us. Please read our ‘Survivor’s Group Chat (Facebook): Information, Rules & Guidelines prior to requesting membership to the group.
Newsletter: When you, the user, sign up to our Newsletter (located at the bottom of our Website and through our other communication channels such as social media), you enter your name and email address. This identifiable information will never be revealed or published publically on our Website, or through any other communication channels we may use, and will be processed securely in accordance with our Privacy Policy. This identifiable information is for the purpose of communicating and engaging with you via our email distributions. Please read our Privacy Policy prior to signing up for our Newsletter.
Google Form & Google Drive: When you, the user, use and engage with our Google Forms & Google Drive which are used to, but not limited to, gather information, conduct surveys, collect feedback, obtain polls, share ideas, share Content, distribute information, measure interest, and receive volunteering and collaborating registrations of interest, you may enter, among other information, your name, email address and age group. Identifiable information will never be revealed or published publically on our Website, or through any other communication channels we may use, and will be processed securely in accordance with our Privacy Policy. This information is for the purpose of communicating and engaging with you via our communication channels.
  • Any information in user-generated content that contains any identifiable information will be redacted before being published to the Website or shared across any of our other communication channels, such as social media platforms. Unfortunately, this means that we are unable to link UGC to personal blogs, individual social media pages, books you have authored, or other related initiatives.
  • You, the user, are free however, to share any of our upcoming events that have been made available on our Website (specifically on the ‘THE SURVIVOR’S HUB’ page of our Website) on your individual social media pages or with others for the sole purpose of informing and communicating with others about such events and Services.
  • Beyond Surviving may share anonymous UGC3 on our social media and networking platforms and any other communication channels we use, in the sole interest of contributing to the community we aim to foster, raising awareness of DSGBVA and any other related purposes, sharing victim-survivor insights, discoveries, learnings, submissions etc. with others in the best interests of fellow victim-survivors and the community and any other purpose we deem necessary or useful to support our work, our Website and Services (see Section 10.2 of this document ‘Terms and Conditions’). Any such UGC that we do share, will have any identifiable information redected prior to sharing, publishing and/ or posting.

8. Liability and and Disclaimer

8.1 To the extent permitted by law, Beyond Surviving excludes all express or implied conditions, warranties, representations, or other terms which may apply to the Content and Services provided on the Website.

8.2 Beyond Surviving will not be held liable to any user for loss or damage arising from the use of our Website or Services, whether arising in contract, tort, statutory duty, or otherwise.

8.3 Beyond Surviving relies on crowd sourced Content to provide certain information. We do not guarantee the accuracy of the information on the Website, and disclaim all liability for errors or inaccuracies in the information provided.

8.4 In cases where links to other Websites, Services or resources (“Linked Sites”) are provided on our Website, Beyond Surviving assumes no responsibility for the contents of these third-party offerings and does not make any representations regarding the content or accuracy of materials on such third-party websites. If you decide to access linked third-party Websites, you do so at your own risk and in accordance with the prevailing terms and conditions, policies and agreements of such third-party sites and providers.

8.6 The use of the Website and the Content is entirely at your own risk. Beyond Surviving shall not be liable and shall not otherwise be deemed to be in breach of these T&Cs, for any failure to perform (and/or delay in performing) any of its obligations hereunder caused by circumstances beyond its reasonable control. Beyond Surviving does not warrant that the Website will operate error-free or that the Website and its servers are free of computer viruses or other harmful elements. If your use of the Website results in the need for servicing or replacing equipment or data, Beyond Surviving is not responsible for those costs.

8.7 Beyond Surviving, to the fullest extent permitted by law, disclaims all conditions and warranties, express or implied including any warranty or terms of merchantability, non-infringement of third parties rights, quiet enjoyment and fitness for particular purpose. In no event shall Beyond Surviving, its suppliers, or any third-parties mentioned at the Website be liable for any damages whatsoever (including, without limitation, incidental, punitive, exemplary, special and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the Website and the Content, whether based on statute, contract, tort (including negligence), or any other legal cause, and whether or not Beyond Surviving is advised of the possibility of such damages.

8.8 You acknowledge and agree that the limitations set forth above are fundamental elements of this Agreement and the Website would not be provided to you in the absence of such limitations. Links to and from other websites (“Linked Sites”) may contain links to third-party Websites and resources. These links are provided solely as a convenience to you and not as an endorsement by Beyond Surviving of the Content on such third-party Websites.


8.9 The Website is a resource for the general public and is controlled by Beyond Surviving from its location within Ireland. Those who choose to access this Website from other locations do so on their own initiative and are responsible for compliance with applicable local laws. Any disputes, claims or proceedings arising out of or in any way relating to the Content or the Website shall be governed by the laws of Ireland. The Irish Courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in any way relating to the Content or the Website.

8.10 Any Services provided by a third-party in connection with the Website may be subject to additional terms and conditions. It is your responsibility to review and familiarise yourself with these terms and conditions.

8.11 While Beyond Surviving takes reasonable care in ensuring that the Website provides useful, free and proper information, the Content may contain inaccuracies or typographical errors. We will make every effort to correct errors brought to our attention. However, Beyond Surviving makes no representations or warranties about the lawfulness, accuracy, reliability, completeness, or timeliness of the Content or about the results to be obtained from using the Website.

9. Website Availability

9.1 The Website is provided on an “as available” basis. Although we will make every reasonable effort to ensure continued uninterrupted access, there may be occasions where such access will be unavailable.

9.2 If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Beyond Surviving may at any time and without liability modify, suspend or discontinue the Website or any Content (or any part or specification thereof), with or without notice, for any valid technical, operational, safety or commercial reasons. These T&Cs constitute the entire Agreement between you and Beyond Surviving with respect to the use of the Website.

10. Sharing User-Generated Content, Social Media & Networking Platforms

10.1 Communication, engagement, and actions taken through external social media and networking platforms that we participate on are custom to the terms and conditions as well as the data protection and privacy policies and notices and agreements held with each social media and networking platform respectively. You are advised to use social media and networking platforms wisely and communicate/ engage upon them with due care and caution regarding your own privacy and personal details. We encourage you when wishing to discuss sensitive details to contact us through primary communication channels such as our email (info@beyondsurviving.ie) or through the ‘Share your Journey’ functionalities made available to you on our Website which is published to our Website anonymously (upon review).

10.2 By using and engaging with the ‘Share your Journey’ function, the Services and Linked Sites which have been made available on the Website, making submission(s), using the functions to comment on other submission(s) submitted using the ‘Share your Journey’ function, you the user, give Beyond Surviving permission to anonymously publish your user-generated content (and redacted Content where necessary) on our social media platforms and any other communication channels we use, in the sole interest of contributing to the community we aim to foster, raising awareness of DSGBVA and any other related purposes, sharing victim-survivor insights, discoveries, learnings etc. with others in the best interests of fellow victim-survivors and the community and any other purpose we deem necessary or useful to support our work, our Website and Services. By using these functions on our Website, you affirm that this is agreed, understood and consented to. We will never publish your identifiable information on our Website or other communication channels we use, such as social media and email marketing platforms.

10.3 Should you, the user, wish for your user-generated content not to be published on our social media platforms or any other communication channels we use such as email marketing platforms, you can contact us at: info@beyondsurviving.ie. Otherwise, we assume consent is affirmed and clearly articulated by you as per ‘the Agreement’ and your use of our Website.

11. Variations to the Website and T&Cs

11.1 Beyond Surviving reserves the right to modify the Website, Content, and Services at any time without the requirement to provide notice.

11.2 We reserve the right to change this T&Cs from time to time at our sole discretion. If we make any changes, we will post those changes in this document and update the “last updated” date at the top of this document and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). Once you have received notification of such changes, your continued use of our Website will indicate your awareness and acceptance of those changes and the Privacy Policy and Terms and Conditions are binding upon you as per ‘the Agreement’.

11.3 If you do not agree to be bound by any changes to these T&Cs or to the Privacy Policy, you will not be able to continue to use our Website and Services and you should not use our Website.

12. Governing Law, Jurisdiction and Venue

12.1 The Irish courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Website although we retain the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.

12.2 These T&Cs and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Ireland.

13. Termination

13.1 Beyond Surviving reserves the right to restrict, remove, or prevent access to our Website and Services if you fail to comply with these T&Cs or you are in breach of the contract concluded with you (the Agreement). Such actions are at our sole discretion.

13.2 If any of these T&Cs are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to the extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

14.2 If you have any concerns, queries, or complaints regarding your data privacy, please refer to the relevant section in our ‘Privacy Policy’.

All contents of the Beyond Surviving Website are subject to copyright. All rights reserved. The intellectual property of Beyond Surviving™ is a registered trademark and is filed under the Intellectual Property Office of Ireland (trademark registration number: 270505).

16. Entire Agreement

These T&Cs and any policies or operating rules posted by us on this Website or in respect to our Website and Services and use of our Website and Services constitutes the entire Agreement and understanding between you and us and govern your use of the Website, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these T&Cs). Any ambiguities in the interpretation of these T&Cs shall not be construed against the drafting party.
